FACT: every member will NOT get a refund.

FACT: Equity Buy-In amounts were actually $0 (ZERO) dollars for builds prior to 2001. They are now $4,600. See below:

Member-owners have been repeatedly threatened with the mention of assessments for big-ticket-items
such as the clarifier & fencing, neither of which has been mandated or necessary:

FACT: There are no “mandated” upgrades at this time.
A LIE: “a June 2024 TCEQ Inspection found numerous violations in both water and wastewater that had been ignored for years.”

FACT: Our research shows no June 2024 “Violation” as cited by Ms. Flunker. However, there are two violations that do come up. A June 2022 Notice of Violation (#1811241) and an August 2024 violation (#2001845). Both of these cite 290.44(h)(1)(A); 290.44(h)(4); 290.47(f) which appears to reference residential “backflow-issue.” You can do your own SEARCH HERE for WINDERMERE OAKS WSC (RN101276236) to find violations.
A LIE: “The TCEQ identified issues we now have required projects to complete including fencing the 24 acre effluent field and replacing the aging clarifier.”

FACT: Fencing the effluent was a TCEQ “guideline” only not required of WOWSC due to location in gated community with low public traffic. Signage suggested.
FACT: The TCEQ did not require the clarifier to be replaced. There was no violation. In a routine inspection the existing clarifier was determined by TCEQ to need repairs in order to level the structure. See: Clarifier-unlevel. This repair would fall under general maintenance/ & repair and should be on the WOWSC contractor’s “to-do” list.

FACT: Fencing was estimated to cost $20,000-$25,000 for 24 acres of fencing. However, fencing is not required of WOWSC. $20,000 is not a Million!
FACT: A few years ago when the lake was extremely low with turbidity high, there was concern that the clarifier might not keep pace. At that time an estimate of $300-400,000, for a new clarifier, had been secured. Note: Although not ordered by TCEQ to purchase a new Clarifier, the WOWSC began a special money-saving project to retrofit a larger and unused storage tank and turn it into a clarifier to “add” clarification capacity. Recent boards have ignored the progression of this project.
FACT: $350,000 + $30,000 is not a Million! And, neither is required anyway.
